Terms and Conditions

These General Terms and Conditions apply to contracts, offers, reservations, and sales of bicycles, e-bikes, accessories, spare parts, as well as workshop and serviceleistungen by Georgs Fahrradladen e.K.

The website currently primarily serves for information, contact, appointment booking, consultation, test ride requests, and catalog display. A direct online purchase via Shopify Checkout is not currently intended.

The display of products, bicycles, e-bikes, accessories, or services on our website does not constitute a legally binding offer, but rather serves for information and non-binding inquiry.

A contract is only concluded when we expressly accept an offer, confirm an order, perform a service, or the purchased item is handed over in the store or by individual agreement.

For individually ordered, reserved, or configured bicycles and e-bikes, special agreements may apply, which are laid down in the respective offer or purchase contract.

Inquiries regarding consultations, workshop services, callbacks, and test rides made via the website are non-binding. A requested appointment is only confirmed once we explicitly confirm it.

Reservations for bicycles, e-bikes, or accessories are only binding if explicitly agreed upon. The specific conditions of a reservation are determined by the respective agreement.

The prices individually agreed upon at the time of contract conclusion shall apply. Prices for ancillary services, accessories, modifications, workshop services, spare parts, delivery, or other additional services will be shown or agreed upon separately.

Unless otherwise agreed, payment is due at the latest upon handover of the purchased item or upon completion of the agreed service.

If the customer defaults on a due payment, the statutory provisions apply. We reserve the right to withdraw from the contract or assert further legal rights in accordance with the statutory requirements.

Delivery dates and provision dates are only binding if they have been expressly agreed upon as such.

If collection from the store has been agreed upon, we will inform the customer as soon as the purchased item or service is ready. The customer is obliged to accept the goods within a reasonable period.

Deliveries are only made if this has been expressly agreed upon in individual cases.

The manufacturer, importer, or supplier reserves the right to make changes to the design, model, color, or equipment, provided that these changes are reasonable for the customer and do not significantly alter the purchased item.

During a test ride, the customer is obliged to treat the bicycle or e-bike carefully and as intended. The customer is liable for damages culpably caused during a test ride in accordance with statutory provisions.

The delivered goods remain our property until full payment has been made.

As long as ownership has not yet been transferred, the customer is obliged to treat the goods with care and to inform us immediately of any third-party access.

Statutory defect liability rights apply.

For new goods, the statutory warranty periods apply. For used goods, a reduction of the limitation period for defect claims can only occur if this is permissible under statutory requirements and has been separately agreed upon.

No defect claims exist for damages caused by improper use, overuse, lack of maintenance, unintended use, subsequent modifications by the customer, or by disregard of care, maintenance, or operating instructions.

The agreed services and prices apply to workshop and service work. Cost estimates are only binding if expressly designated as such.

If it becomes apparent during a repair that additional work or spare parts are required, we will inform the customer, as far as necessary and possible.

For leasing or company bike inquiries, the terms and conditions of the respective leasing provider and the individual approval or processing through the employer or provider also apply.

A leasing agreement is not concluded solely through an inquiry on our website.

We are liable without limitation in cases of intent, gross negligence, injury to life, body or health, and in accordance with mandatory legal provisions.

In the event of slight negligence in the breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract. Otherwise, the statutory provisions apply.

Insofar as a distance contract is concluded with consumers, the statutory rights of withdrawal and the separate cancellation policy apply.

For contracts concluded exclusively in a retail store, there is generally no statutory right of withdrawal.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

For consumers, the statutory places of jurisdiction apply.

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction, to the extent legally permissible, is the registered office of our company.

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply.
